4.3. Your membership will continue until:

(a) the date you terminate your membership in accordance with these Terms of Use; or

4.4. You acknowledge and agree that only you are permitted to use your membership and/or account and no other person.

5. Automatic Renewal

5.1. Where your membership has a fixed term, you acknowledge and agree that unless you notify GONE GLOBAL (in the manner prescribed by this Website) that you do not wish to renew your membership within 7 days from the end of your current membership term then:

(a) your membership will be automatically renewed for a term of the same length as the preceding term; and

(b) the fees and charges relating to your new membership will be those determined in accordance with Clause 8.1.

5.2. Where you have subscribed to services that have a fixed term, you acknowledge and agree that unless you notify GONE GLOBAL (in the manner prescribed by this Website) that you do not wish to renew any services to which you subscribe in addition to your membership within 7 days from the end of the current term of those services then:

(a) those services will be automatically renewed for a term of the same length as the preceding term; and

(b) the fees and charges relating to those services will be those determined in accordance with Clause 8.2.

5.3. You irrevocably authorise GONE GLOBAL to deduct and charge the fees and charges applicable under Clause 5.1 and/or 5.2 using your credit card and credit card details as supplied to GONE GLOBAL.

6. Failure to Renew

Where your membership has a fixed term and it is not renewed (either by you or GONE GLOBAL in accordance with these Terms of Use), you acknowledge and agree that your membership, member account and/or your access to this Website and all other GONE GLOBAL Websites may be modified or disabled by GONE GLOBAL in its discretion.

7. Termination

7.1. You acknowledge and agree that GONE GLOBAL may terminate your membership and/or any other services to which you subscribe without notice if:

(a) you do not satisfy any of the eligibility criteria set out in Clause 2.1;

(b) you breach any of your obligations under these Terms of Use and fail to remedy that breach (if capable of being remedied) within 7 days of receiving notice of the breach from GONE GLOBAL;

(c) your member account remains unused for a continuous period of three months or more; or

(d) GONE GLOBAL gives you one month's written notice (via your nominated email address) that your membership is terminated.

Upon the termination of your membership and/or any other services pursuant to this clause, you will immediately forever forfeit any right or interest in any money previously paid to GONE GLOBAL in respect of that membership and/or those services and you will remain liable to pay any unpaid money owing to GONE GLOBAL as at the date of termination.

7.2. You may terminate your membership and/or any other services to which you subscribe at any time for any reason provided you do so by giving notice to GONE GLOBAL:

(a) by Manually Terminating your Account under Settings within this Website or any other Gone Global Website.

(b) strictly in accordance with any other procedure set out on this Website.

Subject to the following, you acknowledge and agree that the termination of your membership and/or any other services pursuant to this clause will take effect from:

(a) upon the expiration of the current term of your membership and/or services where a fixed term and a fee applies to the membership and/or services; or

(b) otherwise, immediately upon manually Terminating your Account in the Settings section of this website or any other Gone Global Website.

Upon the termination of your membership and/or any other services pursuant to this clause, you will immediately forever forfeit any right or interest in any money previously paid to GONE GLOBAL in respect of that membership and/or those services and you will remain liable to pay any unpaid money owing to GONE GLOBAL as at the date of termination.

8. Fees and Charges

8.1. You acknowledge and agree that GONE GLOBAL may at its sole discretion determine the fees and charges applicable to your membership, which will apply upon the commencement or any renewal of your membership. GONE GLOBAL does not represent or warrant that memberships that are initially provided free of charge or at a discount will remain so.

8.2. You acknowledge and agree that GONE GLOBAL may at its sole discretion determine the fees and charges applicable to any services it offers in addition to memberships, which will apply upon the commencement or any renewal of your subscription to such services. GONE GLOBAL does not represent or warrant that any additional services that are initially provided free of charge or at a discount will remain so.

8.3. You acknowledge and agree that all payments owing to GONE GLOBAL in respect of this Website or any other GONE GLOBAL Website, including memberships, must be made using PayPal or a credit card issued by a financial institution approved by GONE GLOBAL and no other method.

9. Security

9.1. Subject to thePrivacy Policy, you acknowledge and agree that it is your sole responsibility for maintaining the security and integrity of your username, login and password/passcode relating to your membership and member account.

9.2. You agree to read any advice regarding security that is posted on this Website from time to time.

9.3. You agree to keep your login and password/passcode relating to your membership and member account confidential and agree not to disclose them to any person.

9.4. You agree to immediately notify GONE GLOBAL of any unauthorised use of your membership or member account via Contact Us Forms on this Website.

10. Permitted / Prohibited Use

10.1. You agree to not use this Website or any other GONE GLOBAL Website other than for the purpose it is intended, which is engaging in social interaction with other members of the public.

12. Content Location

12.1. Without limiting Clause 10 or Clause 11, you agree not to post, upload or otherwise transmit content (including words, images, video and audio) on this Website or any other GONE GLOBAL Website unless you do so on the appropriate pages or areas of this Website or other GONE GLOBAL Website as designated by GONE GLOBAL.

12.2. You acknowledge and agree that if you do not comply with Clause 12.1 then GONE GLOBAL may:

18.4. Subject to the Singapore Law, you acknowledge and agree that you must not commence any claim or action against GONE GLOBAL more than 6 months after the relevant cause of action arose.

19. Dispute Resolution

If you have a complaint against GONE GLOBAL you acknowledge and agree that:

(a) you must attempt to mediate your complaint in good faith before it is heard by a court or tribunal of law;

(b) the appointment of a mediator must be agreed by you and GONE GLOBAL jointly or, failing agreement, must be appointed by the standard Singapore Legal methods for mediation;

(c) the mediation is confidential and statements (oral or written) relating to the mediation must not be used in any legal proceedings; and

(d) the fees charged by the mediator must be shared equally by you and GONE GLOBAL, otherwise you must bear your own costs relating to the mediation.

20. General Provisions

20.1. These Terms of Use and the application thereof are governed by the laws of Singapore.

20.2. You and GONE GLOBAL irrevocably and unconditionally submit to the non-exclusive jurisdiction of the courts and tribunals of Singapore and courts hearing appeals from those courts and tribunals in respect of any dispute between you and GONE GLOBAL.

20.3. You must not commence any proceeding, claim or any other legal process against GONE GLOBAL in any court or tribunal except for the courts and tribunals of the Singapore.

20.4. If a provision of these Terms of Use or the application thereof is void, illegal or unenforceable in any jurisdiction then it may be severed and will not affect the validity, legality or enforceability of the remaining provisions.

20.5. The rule or principal of interpretation known as contra proferentem does not apply to these Terms of Use or the Privacy Policyand a party is not to be disadvantaged merely because that party was responsible for the preparation of these Terms of Use or the Privacy Policyor the inclusion of a particular provision of those documents.

20.6. Your rights and obligations under these Terms of Use are personal to you and may not be assigned or transferred to any other person.

20.7. Unless expressly stated otherwise, the provisions of these Terms of Use will survive the termination of your membership.
